Abstract:
The article is aimed at studying the problems of lifting the moratorium on the sale of agricultural land and the introduction of the free circulation of such land property. The article analyzes the arguments of both supporters and opponents of the introduction of free trade of agricultural land. Both the short-term and long-term effects of the immediate and unconditional lifting of the moratorium are forecasted, as required by proponents of the introduction of the free circulation of agricultural land property. The forecast of negative consequences because of the immediate and unconditional lifting of the moratorium is substantiated. In particular, the move is expected to result in the concentration of the bulk of land property owned by several large investors, accompanied by reduction in the productivity of agricultural land as a result of the use of land for lower value-added agricultural products competing with small and medium-sized farms’ output. Long-term negative socio-economic consequences such as a decline in rural employment and, as a consequence, creation of preconditions for further migration of working people abroad are also projected. The fundamental differences between the simple lifting of the moratorium and the implementation of a full-fledged land reform have been defined. A list of the main tasks of land reform, which should be implemented before the opening of the agricultural land market, as well as a detailed list of the main directions and separate elements of this reform are proposed. The main directions include measures of legal regulation, economic and fiscal measures, as well as organizational and technical measures that will create the foundation for the organization of the real land market for agricultural purpose, the operation of which would really ensure respecting the legitimate interests of the owners of land units, the State, and the Ukrainian people in general.
